PLEASE TAKE A MOMENT TO REVIEW THESE TERMS OF SERVICE. THEY CONTAIN CRUCIAL INFORMATION THAT IMPACTS YOUR RIGHTS, REMEDIES,
AND RESPONSIBILITIES.

THESE TERMS INCLUDE AN AGREEMENT TO ARBITRATE (UNLESS YOU CHOOSE TO OPT OUT) AND PROHIBIT CLASS AND REPRESENTATIVE ACTIONS, AS WELL AS NON-INDIVIDUALIZED RELIEF IN BOTH COURT AND ARBITRATION.

YOU’LL FIND VARIOUS LIMITATIONS AND EXCLUSIONS, A CLAUSE THAT
DETERMINES THE JURISDICTION, VENUE, AND GOVERNING LAW FOR DISPUTES (EXCEPT WHERE PROHIBITED), AND REQUIREMENTS TO ADHERE TO APPLICABLE LAWS AND REGULATIONS.

Introduction


Rideshare Depot (“Rideshare Depot”,“we”, or “us”) provides an online car sharing platform specifically designed for individuals who want to rent vehicles to work as drivers for Uber. Rideshare Depot connects vehicle owners with travelers and locals seeking to book those vehicles. Rideshare Depot is accessible online, including at ridesharedepot.com and via applications for mobile devices. The Rideshare Depot websites, blog, mobile applications, and associated services are collectively referred to as “the Services”. By accessing or using the Services, including by communicating with us or other Rideshare Depot users, you agree to comply with, and be legally bound by, the provisions of these Terms of Service (these “Terms”), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and Rideshare Depot.

These Terms, together with the cancellation policy, nondiscrimination policy, applicable insurance terms and certificates, roadside assistance terms, and the additional policies (together, the “Policies”) constitute the “Agreement” between you and Rideshare Depot (each a “Party” and together, “the Parties”). In addition, Rideshare Depot provides a Car Sharing Agreement that summarizes the terms of each reservation, accessible in the Services for any booked or previous trips, and you may use it as proof of a reservation.

Modification


Rideshare Depot reserves the right, at our sole discretion, to modify the Services or the Agreement, including these Terms, at any time. If we modify these Terms, we will post the modification on the Services. We will also update the “Last Revised” date at the top of these Terms. If you continue to access or use the Services after we have posted a modification or provided you with notice of a modification, you are indicating that you agree to be bound by the modified terms. If the modified terms are not acceptable to you, your sole recourse is to stop using and accessing the Services and close your Rideshare Depot Account within 30 days. If you choose to close your Rideshare Depot Account, the previous effective version of these Terms will apply to you, unless you use the Services during the intervening 30-day period, in which case the new version of these Terms will apply to you.

Eligibility, Registration, Verification

Eligibility, Registration, Verification

The Services are intended solely for guests who meet our eligibility requirements in South Carolina and are 21 or older. Any use of the Services by anyone who does not meet these eligibility requirements is expressly prohibited. No at-fault major accidents in the last 5 years, no super speeder tickets, carry an Uber rating of 4.85 or greater, and must have completed at least 1,000 combined trips.

Registration

To access certain features of the Services, you must sign up for an account with us (a “Rideshare Depot Account”). You can create a Rideshare Depot Account by providing us with your first and last name, email address, mobile phone number, and creating a password. You must apply to be a fleet driver. You must provide accurate, current, and complete information during the registration, booking, and/or listing process. You must keep your Rideshare Depot Account up to date at all times. Based on the information you provide, Rideshare Depot may impose additional requirements for you to book a car (e.g., providing a deposit, adding a second form of payment, buying a certain level of protection plan, or other requirements).

Verification

Where permitted, Rideshare Depot has the right, but not the obligation, to undertake screenings, checks, and engage in processes designed to: Help verify the identities or check the backgrounds of users, including driving history and driver’s license validity.

Rideshare Depot does not endorse any vehicle, user, or a user’s background, nor commit to undertaking any specific screening process. Rideshare Depot may, at its sole discretion, use third-party services to verify the information you provide to us and to obtain additional related information and corrections where applicable, and you hereby authorize Rideshare Depot to request, receive, use, and store such information. Rideshare Depot may permit or refuse your request to book or list a vehicle at its sole and absolute discretion.

Consumer Report Authorization

When you attempt to book a vehicle, or at any time thereafter where Rideshare Depot reasonably believes there may be an increased level of risk associated with your Rideshare Depot Account, you hereby provide Rideshare Depot with written instructions and authorize Rideshare Depot, in accordance with applicable consumer reporting laws, to obtain your personal and/or business auto insurance score, credit report, and/or conduct a background check, including a criminal background check where permissible under applicable law. This authorization will remain valid for three years from the date of your first booking.

Fees, Taxes

Fees

The fees we charge for using the Services and other cost structures will be itemized at checkout for guests. You can verify the amount for your rental at checkout before you submit your rental request. When you provide Rideshare Depot with a payment method, you authorize Rideshare Depot, or third-party service providers acting on behalf of Rideshare Depot, to store your payment credentials for future use in the event you owe Rideshare Depot any money. You authorize Rideshare Depot to use stored payment credentials for balances (e.g., late fees, security deposits, recovery, delivery, processing fees, claims costs, and related administrative fees). In some cases, our payment processors have arrangements with card networks to automatically update stored payment credentials whenever you receive a new card (e.g., replacing an expired card or one that was reported lost or stolen), and we will rely on such updates to stored payment credentials for balances. Any use of referral travel credit is governed by the terms and conditions outlined here.

Collection of Fees

Rideshare Depot and its service providers will employ all legal methods available to collect amounts due, including the engagement of collection agencies or legal counsel. Rideshare Depot, or the collection agencies we retain, may also report information about your Rideshare Depot Account to credit bureaus. As a result, late payments, missed payments, or other defaults on your Rideshare Depot Account may be reflected in your credit report. In addition to the amount due, delinquent accounts or chargebacks will be charged with fees and/or charges that are incidental to the collection of delinquent accounts or chargebacks, including, but not limited to, collection fees, convenience fees, and/or other third-party charges. If you wish to dispute the information Rideshare Depot reported to a credit bureau (i.e., Experian, Equifax, or TransUnion), please contact help.ridesharedepot.com. If you wish to dispute the information a collection agency reported to a credit bureau regarding your Rideshare Depot Account, you must contact the collection agency directly.

Taxes

In South Carolina, Rideshare Depot may enable the collection and remittance of certain taxes, based on existing and future tax regulations, including marketplace facilitator or car sharing regulations. The amount of taxes, if any, collected and remitted by Rideshare Depot will be visible in documents and invoices.

Your Commitments

You agree that you will always use your Rideshare Depot Account and the Services in compliance with these Terms, applicable law, and any other policies and standards provided to you by Rideshare Depot.

Account Activity

You are, and will be, solely responsible for all activity that occurs through your Rideshare Depot Account. Keep your Rideshare Depot Account information, including your password, secure. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Rideshare Depot Account, whether you have authorized such activities or actions. You will immediately notify Rideshare Depot of any actual or suspected unauthorized use of your Rideshare Depot Account. We are not responsible for your failure to comply with this clause or for any delay in shutting down or protecting your Rideshare Depot Account unless you have reported unauthorized access to us.

Rideshare Depot Content and User Content License

Content

Subject to your compliance with these Terms, Rideshare Depot grants you a limited, revocable, non-exclusive, non-transferable license to access and view any Rideshare Depot and/or user content to which you have access, solely for your personal and noncommercial purposes. You do not have the right to sublicense the license rights granted in this section. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Rideshare Depot or its licensors, except for the licenses and rights expressly granted in these Terms.

User Content

We may, at our discretion, allow you to post, upload, publish, submit, or transmit content through our Services, such as photographs of you and your vehicle(s), reviews, feedback, and descriptions of yourself, your vehicle, or your trip. By making any content available on or through our Services or through Rideshare Depot promotional campaigns, you grant Rideshare Depot a worldwide, irrevocable, perpetual (or for the term of the protection), non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such content to promote or market the Services. Except for Rideshare Depot photography provided to hosts, Rideshare Depot does not claim ownership rights in any such content, and nothing in these Terms restricts your rights to use and exploit that content.

Copyright Protection

We respond to notices of alleged copyright infringement and will terminate accounts of repeat infringers in accordance with the process outlined in the US Digital Millennium Copyright Act and similar laws. If you believe a user is infringing on your copyright(s) and wish to notify us, you can find information about submitting notices here.

Google Terms

Some areas of our Services utilize Google Maps/Places mapping services, including the Google Places API. Additionally, to combat spam and abuse of our Services, Rideshare Depot has implemented reCAPTCHA Enterprise, a Google service. By using our Services, you agree to abide by Google’s Terms of Service.

Prohibited Activities

In connection with your use of or access to our Services, you agree that you will not, nor advocate, encourage, request, or assist any third party to:

Violate any law, including:

Breaching, violating, or circumventing any local, state, provincial/territorial, regional, or national law or regulation, or any court order, including airport regulations and tax regulations, Uber guidelines, licensing or registration requirements, or third-party rights.

Post false, inaccurate, misleading, defamatory, or libelous content.

Infringe upon, reproduce, perform, display, distribute, reverse engineer, or create derivative works from content that belongs to or is licensed to Rideshare Depot or that belongs to another user of the Services, including works protected by copyrights, trademarks, patents, or other intellectual property rights, except with prior express written permission from Rideshare Depot.

Dilute, tarnish, or harm the Rideshare Depot brand in any way, including:

  • Unauthorized use of the Services and/or user content.
  • Registering or using “Rideshare Depot” or similar terms in domain names, trade names, trademarks, or otherwise.
  • Registering or using domain names, trade names, trademarks, social media account names, or other identifiers that closely imitate or are confusingly similar to Rideshare Depot’s domains, trademarks, taglines, promotional campaigns, or user content.

Provide or submit any false or misleading information, including:

  • False name, date of birth, driver’s license details, payment method, insurance, or other personal information.
  • Information related to claims (e.g., damage to a vehicle).
  • Registering for a Rideshare Depot account on behalf of another individual or entity.
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

Fail to honor your commitments, including:

  • Not paying fees, penalties, or amounts owed to Rideshare Depot or another user.
  • Failing to deliver, make available, or return any vehicle and optional extras on time, unless you have a valid reason.
  • Using the Services to find a guest and then completing a transaction partially or wholly outside of the Services to avoid paying any fees related to the Services (i.e., gray market transactions).
  • Transfer your Rideshare Depot account and/or user ID to another party without our consent.
  • Leave a vehicle unlocked or running with the keys inside, except as directed by Rideshare Depot in specific limited circumstances.

Harm or threaten to harm users of our community, including:

  • Harassing, stalking, or defaming any other Rideshare Depot user or collecting or storing personally identifiable information about any other user, except for the purposes of transacting as a host or guest in accordance with these Terms.
  • Engaging in physically or verbally abusive or threatening behavior.
  • Using the Services to transmit, distribute, post, or submit information concerning any other person or entity, including photographs of others without their permission, personal contact information, payment method details, or account numbers.
  • Treating anyone differently based on their appearance, sexual orientation, beliefs, identity, origin, or age. Discrimination of any kind is not tolerated within the Rideshare Depot community.
  • Sue or assert legal claims against Rideshare Depot or another user in any manner prohibited or waived by these Terms.

Use the Services for unrelated purposes, including:

  • Contacting another Rideshare Depot user for any reason other than booking, vehicle inquiries, or using the Services.
  • Commercializing any content found in the Services or software associated with the Services, including reviews.
  • Harvesting or collecting information about users without their and our consent, including conducting background checks.
  • Recruiting or soliciting any user to join third-party services or websites that compete with Rideshare Depot, without our prior written approval.

Interfering with the operation of the Services, including:

Interfering with any other user’s listings.

  • Using the Services to distribute unsolicited commercial messages (e.g., spam).
  • Distributing viruses or any harmful technologies such as cancel bots, Trojan horses, or harmful code that may disrupt or interfere with the Services or harm Rideshare Depot or others’ interests or property.
  • Bypassing robot exclusion headers, interfering with the Services’ operation, or imposing an unreasonable load on our infrastructure. Systematically retrieving data or other content from the Services to create a collection, compilation, database, directory, or similar, whether by manual methods or automated technologies.
  • Accessing, tampering with, or using non-public areas of the Services, our computer systems, or the technical delivery systems of our service providers.
  • Attempting to probe, scan, or test the vulnerability of any of our systems or networks or breach any security or authentication measures.
  • Circumventing any technological measures implemented by Rideshare Depot or any of our service providers to protect the Services.
  • Forging any packet header or any part of header information in any email or newsgroup posting, or otherwise using the Services to send altered, deceptive, or false identifying information.
  • Attempting to decipher, decompile, disassemble, or reverse engineer any software used to provide the Services.
  • Endeavoring to circumvent a suspension, termination, or closure of your Rideshare Depot account or another user’s account, including creating a new account or listing vehicles affiliated with or registered to an account holder that has been suspended or terminated.

Violations

Rideshare Depot has the right, but not the obligation, to investigate, pursue, and seek to prosecute, litigate, or refer to law enforcement, violations of these Terms to the fullest extent permissible by law.

Rideshare Depot reserves the right, at any time and without prior notice, in accordance with applicable law, to remove or disable access to any content that we, at our sole discretion, consider objectionable, in violation of these Terms, or otherwise harmful to the Services or our community. If we believe you are abusing Rideshare Depot, our users, or any other person, or violating the letter or spirit of these Terms, we may, at our sole discretion and without limiting other remedies, limit, suspend, or terminate your account and access to the Services, remove hosted content, deny a damage claim, remove or demote your listings, reduce or eliminate any discounts, and take technical or legal steps to prevent you from using the Services. Additionally, we reserve the right to refuse or terminate access to the Services to anyone for any reason at our discretion, to the fullest extent permitted by applicable law.

Communications with You

Communications witYou agree that Rideshare Depot may contact you by electronic means (e.g., email, notifications via Rideshare Depot messaging, app notifications) instead of mailed notices. To contact you more efficiently, we may also reach you using autodialed or prerecorded message calls or text messages at your phone number(s). We will not place such calls for marketing purposes but may place calls or texts to confirm your signup, provide notices regarding your account activity, investigate or prevent fraud, collect debts, or communicate urgent messages.h You

Specific terms for guests

Guest Commitments

As a guest, you agree to be a legally licensed driver and must provide proof of a current, valid driver’s license to the host or through our Services. You will treat the vehicle and any associated Extras with care and take reasonable steps to return them on time and in essentially the same condition as when you received them. Only individuals designated in the trip details as Approved Drivers may operate the vehicle you booked.

Use of the Vehicle

When you book a vehicle through our Services, you agree to use it solely for personal or professional purposes and not for any commercial activities (e.g., those requiring a commercial driver’s license) unless you have received prior express written permission from our Legal Department. Access to the vehicle is permitted only from the trip’s start time, and you must return it on time to the designated location. You are required to show the host a valid driver’s license and must use reasonable care while operating the vehicle. Compliance with all applicable laws, including speed limits and regulations against impaired or distracted driving, is mandatory.

If we have concerns regarding your vehicle usage, we reserve the right to terminate your trip at any time and require the vehicle’s return, including recovery actions on behalf of the host. Seat belts must be worn by you and all passengers, and you must adhere to any laws concerning child safety seats and protections for children. The vehicle must remain locked, and keys must not be left unsecured (e.g., in the ignition). You must not engage in prohibited activities with any vehicle booked through our Services. If you have questions regarding your intended use, please reach out to us for clarification.

Should you misuse the vehicle, you will be fully responsible for any claims, losses, or damage, injurys, that arise, and your protection plan may be void. Additionally, using a vehicle in a prohibited manner or violating the Agreement could reduce your available liability coverage to the legal minimum or nullify it altogether, as well as negate any comprehensive or collision protection or applicable protection plan.

Telematics Notice and Release

Vehicles booked through our Services may include features or on-board devices that monitor the vehicle’s status during your trip. The non-personal information collected may encompass the vehicle’s condition, performance metrics, and various operational data, such as mileage and location (“Vehicle Data”). Use of these features is governed by the terms and conditions set forth by the vehicle manufacturer or technology provider, which may include limitations and user responsibilities. Unless prohibited by law, you authorize the use or disclosure of the Vehicle Data and agree to inform any Approved Drivers and passengers about this section’s terms. You release the host and agree to indemnify and hold harmless the host and others involved from any damage to persons or property resulting from the operation of these features or devices.

Condition of the Vehicle and Optional Extras

Please conduct a visual inspection before using the vehicle. If you identify any damage during your inspection, upload photos of such pre-existing damage at the start of your reservation to avoid being held liable. If damage is found after your initial inspection and is not reported, we, third-party administrators, or insurance partners may assume the damage occurred during your reservation. If you believe the vehicle is unsafe to drive, refrain from using it and contact our team immediately.
